New FAR Council Model Deviation Text Now Available.
The Federal Acquisition Regulatory Council has released new model deviation text as part of the ongoing Revolutionary FAR Overhaul (RFO) Initiative, in accordance with Executive Order 14275 and OMB Memorandum M-25-26.
The following RFO updates were posted on September 4, 2025:
- Part 8 – Required Sources of Supplies and Services: FAR 8.104(a) has been corrected to clarify that the Office of Federal Procurement Policy (OFPP) will be establishing a new class of “required use” contracts and criteria for qualifying for this class of contract. “Required use” contracts will be separate from “best-in-class” (BICs) contracts. Required use contracts will be mandated for use. BICs will be prioritized, but not mandated.
- Part 7 – Acquisition Planning is open for informal feedback until October 20, 2025.
Implementation Support: Practitioner Album: FAR Part 7 - Part 24 – Protection of Privacy and Freedom of Information is open for informal feedback until October 20, 2025.
Implementation Support: Practitioner Album: FAR Part 24 - Part 44 – Subcontracting Policies and Procedures is open for informal feedback until October 20, 2025.

This release is part of a broader effort to update the FAR by using plain language, removing non-statutory and non-essential content, and making the regulation easier to understand and use. The update also includes summaries, insights, and practical tools to help the workforce transition to and implement the revised regulation. Model deviation text will support agency alignment during the transition to the updated regulation.
